Notice of Hearing - Stop Order Appeal

NOTICE OF HEARING: STOP ORDER APPEAL
As per Section 685 of the Municipal Government Act


An Appeal has been filed against the decision of the Development Authority of Westlock County on:

The Stop Order issued by the Development Authority pursuant to Section 645 of the Municipal Government Act, R.S.A. 2000, c. M-26, as amended (the “Act”), with respect to the following lands:

Land Location: SE 34-59-26-W4


Place: Westlock County Council Chambers; Westlock County Administration Office; 10336 – 106 Street Westlock, AB T7P 2G1
Date: Thursday, January 12, 2023 Time: 9:30 am

The Orders:

[1] To bring the Lands into compliance with the Act and the Westlock County Land Use Bylaw by:
A. Relocating the Shop so that its location complies with the site plan approved by DP 14-120 (20 feet south of property line).
OR

B. Apply for and obtain a new development permit to relocate the Shop (whether to a new location within the Lands or to a new parcel) and carry out the relocation in accordance with the new development permit.
OR

C. Apply for and obtain a new development permit to demolish the Shop and complete the demolition in accordance with the new development permit

Once the Shop has been relocated or demolished, you must also restore the area around the former location of the Shop to its natural state.

Reason for Appeal: To appeal the Stop Order issued November 17, 2022 by Westlock County

The Subdivision and Development Appeal Board for Westlock County (the “SDAB”) will hold a Preliminary Hearing to determine whether this Appeal should be heard by the SDAB or the Land and Property Rights Tribunal. If the SDAB determines that it should hear this Appeal, it will schedule a Hearing on the merits for a later date. The Preliminary Hearing will be held in person at the Westlock County Administration Building, 10336 – 106 Street, Westlock, Alberta.




To make a submission, you may do so in writing to the Secretary of the Subdivision and Development via email to ea@westlockcounty.com or dropping it off at the County office during regular office of hours (8 am – 12 noon & 1 – 4:30 pm).
Written submissions for inclusion in the agenda package for the Subdivision and Development Appeal Board regarding this appeal must be received by the undersigned on or before Wednesday, January 4, 2023. This will allow time for all parties to review all information before the hearing.
